It is widely held that there are no indigenous roots in China for the rule of law; it is an import from the West. The Chinese legal tradition, rather, is rule by law, as elaborated in ancient Legalist texts such as the Han Feizi. According to the conventional reading of these texts, law is amoral and an instrument in the hands of a central ruler who uses law to consolidate and maintain power. The ruler is the source of all law (...) and stands above the law, so that law, in the final analysis, is whatever pleases the ruler. This essay argues, to the contrary, that the instrumentalism of the Han Feizi is more sophisticated and more principled than the conventional reading acknowledges. It suggests that, by examining the text of the Han Feizi through the lens provided by American legal theorist Lon Fuller, we can detect an explicit articulation of what Fuller called the internal morality of law. The principles of this morality are elaborated and their importance explained. In this way, the Han Feizi is retrieved as a significant reference point for thinking about legal reform in China today. At the same time, a prominent group (...) of philosophical bioethicists authored an article, possibly with a touch of defensiveness, to “make the case that philosophy and philosophers still have a very important and meaningful role to play in contemporary bioethics” (Blumenthal-Barby et al. 2021). Meanwhile, the annual meeting of the American Society for Bioethics and Humanities included several expressions of impatience with the historical privileging of philosophy over more empirical, situated, and community-oriented approaches to moral problems in health.DeGrazia and Millum’s work itself reflects the current state of bioethics and how it has changed since the heyday of grand bioethical theory construction in the late twentieth century. To apply Parfit’s philosophical taxonomy (1984), the general frameworks promulgated by theorists like Veatch, Engelhardt, and Gert, as well as Beauchamp and Childress, were by necessity revisionary. These bioethical theories were whole-cloth alternatives to a conventional and paternalistic medical ethos that was already widely acknowledged as unsatisfactory. Today, however, bioethics is a mature and institutionalized field, with well-established practices and a corpus of accepted tenets (alongside matters of ongoing but generally demarcated controversy). A plausible and fruitful contemporary theory of bioethics must be largely descriptive, in Parfit’s sense, providing an intellectual framework that gives coherence and sense to existing practice, while at the same time clarifying matters of confusion.In contemporary bioethics, a central component of this practice is the application of the four principles of biomedical ethics—non-maleficence, beneficence, justice and autonomy—not merely as originally proposed by Beauchamp and Childress (2019), but in their refined form, following decades of exchange, critique, and revision. DeGrazia and Millum’s theory begins with two core values: well-being and respect for rights holders. [End Page 321] The bulk of the book then applies the method of reflective equilibrium to specify these two values in terms of the canonical four principles, here treated as “mid-level” constructs with readier application to specific cases than the two core values. Experienced bioethicists may have an uncanny sense of setting off from a new trailhead, and yet, eventually finding themselves still walking a familiar path. However, this way of introducing and explicating the four principles will likely be more accessible to a wider audience, including high-level undergraduates and graduate students not already versed in the revisions, refinements, and compromises embedded in Beauchamp and Childress’s discussions.Two other features recommend this book as a resource for trainees and interested non-experts seeking to deepen their understanding of bioethics. First, the clarity of its style and organizational approach provides a welcome orientation for non-specialists. The chapters are structured so that major contending perspectives are outlined before the authors develop arguments for their own positions in that context. Each chapter proceeds by considering applications of the broader theory, showing how it can illuminate potential candidate approaches or policies, as well as demonstrating how to use the tools of ethical analysis to evaluate these proposals in both ideal and non-ideal cases. This didactic approach to the relationship between conceptual argument and practice will be accessible to many who are initially unfamiliar with or intimidated by theory. Second the commendable decision to make the book electronically available and accessible also has the potential to broaden the reach of the work, and in particular, to engage parties in under-resourced settings, which have so often been overlooked in bioethical discourse.As noted above, while the authors’ approach is descriptive in Parfit’s sense, it is not necessarily conservative. Responds to the reviews by K. O'Doherty and J. W. Clegg of the current author's book, Relational being: Beyond self and community . One of my chief reactions to the resistances represented in these reviews is that the volume failed to make clear a vision of how we might go on together in the academic world where different viewpoints dominate. To elaborate: both reviewers take issue with my relational account in terms of its seeming dismissal or eradication of cherished concepts—including (...) for Clegg, personal experience, genuine selfknowledge, and independent moral agency; and for O’Doherty, individual awareness, agency, and causality. In a certain sense their resistances are justified. My account raises critical concerns with such concepts, and in certain cases offers a radical reconceptualization. Both reviewers also suggest that these are questions of fundamental ontology, and offer arguments against what they see as my faulty foundations. However, as I tried to explain in the work, I approach theory development from a social constructionist perspective. This means replacing the traditional goal of the theorist to “tell the truth” about the world, with the attempt to generate an intelligibility that may foster different—and possibly more viable—forms of life. In effect, I am not attempting to articulate a final philosophy; I neither propose nor wish to argue ontology. From a constructionist perspective such arguments are futile; on what grounds other than those we construct could we settle such differences? Now to be fair, both Clegg and O’Doherty recognize this constructionist background, and my attempt to avoid eliminating alternative traditions or conceptions. Princeton, NJ: Princeton University Press, 2007, 186 pp., $29.95 cloth.We cannot doubt that, since the turn of the new millennium, there has been something of what Michael Bérubé has called a "Return to Beauty" in cultural (...) and literary scholarship.1 Bérubé locates the beginning of this return in an article written by Marjorie Perloff for the Chronicle of Higher Education in December 4, 1998, and in an opinion that he shares with Rita Felski, he sees it as a misguided attack on cultural studies.2 It is clear that when Elaine Scarry spoke disparagingly of "the enemies of beauty" in her influential book On Beauty and Being Just, she had the more extreme relativists of cultural studies in her sights.3 Far from being a short-lived spat, however, the renewed scholarly interest in beauty has grown, moved on a pace, and shows no sign of intellectual exhaustion; and most of this work has not, as Bérubé would have us believe, directed itself against postmodern aesthetics. Wendy Steiner, in The Trouble with Beauty, took Modernism and the art of the twentieth-century avant-garde as her target;4 whereas John Armstrong's The Secret Power of Beauty provided a sustained and accessible look at the history of aesthetic thought and reminded us of the significance of beauty in our lives, as both a concept and as a value.5 Arthur Danto's The Abuse of Beauty traced, like Steiner, the rejection of beauty to the rise of Modernism. Significantly, he did not attack Modernist art but recognized how it drove a wedge between beauty and the arts, showing us in the process that art need not be beautiful to be of value. In reassessing Modernism's rejection of beauty, however, Danto concluded by arguing forcefully that if beauty need not be excluded from art, it cannot be excluded from everyday living: "Beauty is an option for art but not a necessary condition. But it is not an option for life. It is a necessary condition for life as we would want to live it"6When a scholar with the reputation of Alexander Nehamas turns his attention to beauty, then we know it is still on the agenda in a big way. As with John Armstrong's work, one of the many delights of this book is its clarity of expression and the accessibility of its prose. In no way is Nehamas ever talking down to or patronizing the reader, however. He takes us on a philosophical journey that is rigorously argued and backed up by a wide selection of examples drawn chiefly from the world of art, which is indeed the subject of the writer's attention. If he has cultural studies in his sights, then he is very quiet about it. In fact, the canonical writers of cultural studies, whether they be Foucault, Bourdieu, Williams, or Gramsci, are entirely absent from the text. Instead, the central role goes to Plato—on whom Nehamas has written in two previous publications7—with important [End Page 124] contributions from Schopenhauer, Kant, Nietszche, and Clive Bell, not to mention Proust and Thomas Mann or the artworks themselves. This has a strong whiff of the canon about it perhaps; be that as it may, only a reviewer with a very large ideological drum to beat could remain deaf to the argument itself. For these individuals are all supportive of Nehamas's own thinking and of the argument he has himself developed, which, I think, is not only important to the world of art and art education but, more broadly, to the aesthetics of contemporary schooling itself.Before beginning to look at this argument in detail, it is worth noting that Nehamas has something telling to say about the principles and role of the reviewing process, something that cannot but make me feel wryly self-conscious as I begin it here. MacMillan provides that history, with period illustrations and asides to our day about substituting “prestige” for “honour”, preventive war (a term that isn’t indexed), and even George Kennan’s long telegram. Russell claimed Grey misled Parliament repeatedly about Britain’s commitments (see FO, pp. 501–2). Yet Russell’s 1948 essay “Democracy and Foreign Policy” almost excuses Grey’s covert actions as due to the fear of populist hostility to Germany preventing “the last possibility of general pacification”. It is astonishing how much popular hatred of Germany is revealed in MacMillan’s book. In the bad old days, as Ancona reminds us, he was simply charged with not being Catullus or Propertius; and although the New Critics appreciated his refined irony and playfulness, they still treated him as somewhat of a kinsman of the fairy queen in Iolanthe, who proclaims,On fire that glows with heat intense I turn the hose of common sense.Ancona doubly disturbs the stereotype. Drawing on feminist and gender theory, she traces the recurrent Horatian figure of the (male) poet-lover whose drive for autonomy and control leads him to resist any form of desire that enforces immersion in temporality; and she argues, too, that (mostly male) scholars have privileged that attitude by identifying with it and taking it for granted. The thesis is challenging, it is well argued, and it serves Horace well.Throughout her careful, often elegant analysis of fourteen odes, Ancona traces the poet-lover’s “desperate refusal to situate his own identity in any real relation to the uncontrollable temporality of the beloved” (13). I summarize, baldly, a few results. (1) His desire as he ages is a private sorrow, or even a bid for power (Odes 4.1); hers is a public embarrassment and disgrace (Odes 1.25). (2) He tries vainly to defeat time through imaginings of permanence in nature, or self-identification with youthful eroticism (Odes 1.4) or fantasies of erotic domination (Odes 1.9, 2.9). Or (3): the beloved woman or boy must not be seen as quite real, if the poet-lover’s integrity is to be maintained (Odes 1.22, 2.5). Only in Odes 1.13 and, more compellingly, in the duet of Odes 3.9 does Horace envisage the (to be sure, very distant) possibility of a genuinely evolving love, with both lovers submitting equally to the challenges of time and change.If her results are challenging—and I shall not read Integer Vitae, or Cum tu Lydia, Telephi, or Donec gratus eram tibi so complacently ever again—Ancona’s argument is built from the ground up in ways that reassure the philologist. Her readings are precise and accurate. She is sensitive to Horace’s poetic strategies, his indirections of technique. Ancona acknowledges her debt to earlier critics. Her analyses of Odes 1.23, 1.25, 2.8, 2.9, 3.7, and 4.13 should be required reading for the next generation.Two minor caveats. Ancona’s reading of Odes 1.13 hinges on the interpretation of irrupta... copula as, not “an unbroken bond,” but “an interrupted bond” that yet holds over time and change: a philologically and humanly daring oxymoron. At Odes 3.9.10 I see a strong sexual challenge inscribed in dulcis [End Page 657] docta modos et citharae sciens. Sex and music go together, and Chloe plays well. All the more reason for Lydia, in the next stanza, to turn up the heat.More generally, I wonder whether behind such controlling Horatian personas as the erotodidaskalos of Odes 3.23—a more sensitive, Roman Anacreon—we may not sense the person of a Horace who is remarkably open to the same mysteries of time and change from which his “Horace” so often, and so vainly, struggles to escape? This Horace of mine (let me, this once, be controlling) recognizes Venus as an irreducible power in life and responds to “time and the erotic” with more self-awareness, more passion, and more poetic excitement than has ordinarily been heard in the Odes. To have revived that sense, which I think we share, of ongoing excitement and challenge in the odes on love—though the aesthetic can itself (as in Odes 2.5) be a refuge from life’s changes—is Ancona’s last, best... In this review of Matthew DeCoursey’s book on the aesthetics of drama education, I acknowledge the originality and usefulness of the theoretical framework he provides and attempt to summarize its key features. In applying them to an example of my own practice, I make use of the conceptual terminology DeCoursey has introduced and argue that it is both effective and illuminating to the practitioner. In tracing the trajectory of DeCoursey’s subsequent analysis of key theorists in the field, the study of (...) scripted drama, and the extensive use of drama across the curriculum, I attempt to do justice to the strengths of his argument, as well as pointing out what I perceive as some of its inherent weaknesses. I conclude by indicating some gaps in his attention to both historical and current practices in the field while still commending the book for its much-needed contribution. (shrink)

University of Toronto Press, 2019. 218pp.This most welcome book gets off on the right foot by eschewing such problematic terms as “post-structuralism” or “French theory” in studying the work of French thinkers Gilles Deleuze and Félix (...) Guattari, Jacques Derrida, and Michel Foucault. These terms are of a strictly Anglo-Atlantic provenance, a convenient but misleading encapsulation that facilitated their journey or translation into the Anglo-Atlantic world. Instead, Demers prefers to view this transmission as an ensemble of relays between “people, groups, places, ideas, and moments in time” (3), as well as codes; metalanguages; markets for symbolic capital, a notion derived from Pierre Bourdieu; and “networks of feeling” (5n), a term the author borrowed from Raymond Williams. Demers observes, for example, that there was a relay or “mutual implication” (5) between Paris and Columbia University, which occurred in the aftermath of the events of May ’68, that recalled a somewhat earlier circuit, also leading to Paris, which involved the mid-1960s Berkeley free speech movement. To approach the work of Deleuze and Guattari, Derrida, and Foucault by resorting to terms such as “post-structuralism” or “French theory” severs them from the crucial relays and circuits constituting the complex and highly mobile transpositions of their work to an American intellectual and political milieu, and vice versa, and it is clear that Demers views, quite rightly, that the political and the intellectual are inextricably bound up with each other.Demers acknowledges his debt here to the versions of assemblage theory formulated in Jane Bennett’s Vibrant Matter, Manuel DeLanda’s Assemblage Theory and A New Philosophy of Society, and Bruno Latour’s Reassembling the Social: An Introduction to Actor-Network-Theory. Buttressing these texts for Demers is the work of catalytic significance undertaken by Deleuze and Guattari on assemblages/ensembles. The supervening context for these processes of transmission between France and the Anglo-American world is the global May ’68.Demers’s first chapter deals with Derrida and the notions of translation and margins in order to delineate and analyze the “contiguous [End Page 127] relationship between campus and community” (12). The difficulty Demers grasps here is that Derrida’s work on the place of philosophy, already premised on the defining notion that there is no “we” in the philosophical domain, is rooted in the French educational system, and so is deracinated, inevitably, by its movement out of France into the Anglo-Atlantic world. After seeking to account for the implications of this uprooting, Demers shows convincingly how the later Derrida moved (somewhat) away from the political evasiveness of his earlier writings. Taking Derrida’s “The Ends of Man” as his focus, Demers understands the essay as an attempt to translate the intellectual and practical work being done on the academic and political margins of the university into a properly philosophical position (“deconstruction”) with regard to the logic of margins and centers extending beyond the university. At this point Demers makes two criticisms of Derrida. First, while Derrida’s philosophy pivots on an ever-expanding democracy-to-come, the richness and intricacies of the margins – the very resources created there to disrupt the established centers – have little place in his reflections. Derrida caters to iconic figures such as Martin Luther King, Jr. and Nelson Mandela, who serve as powerful cryptograms for his thinking, but hardly more than that. This stems from a second problem associated with Derrida’s deconstructive positions, namely, that apart from making theoretical moves acclamatory of those positioned on the margins, albeit in relation to a deconstructed and displaced center held in an endless abeyance, it also leaves the Derridean Other in a situation of debilitating indeterminacy – the infinite deferral of Derrida’s différance and the à venir purports to be redemptive, but is ultimately incapacitating. Derrida’s eschatology always trumps his politics. In fact, in his theoretical and practical “spaces,” Derrida’s cat seems to have the same discursive status as Mandela. Analogy and similarity are central phenomena in human cognition, involved in processes ranging from visual perception to conceptual change. To capture this centrality requires that a model of comparison must be able to integrate with other processes and handle the size and complexity of the representations required by the tasks being modeled. This paper describes extensions to Structure-Mapping Engine since its inception in 1986 that have increased its scope of operation. We first review the basic SME algorithm, describe psychological evidence (...) for SME as a process model, and summarize its role in simulating similarity-based retrieval and generalization. Then we describe five techniques now incorporated into the SME that have enabled it to tackle large-scale modeling tasks: Greedy merging rapidly constructs one or more best interpretations of a match in polynomial time: O); Incremental operation enables mappings to be extended as new information is retrieved or derived about the base or target, to model situations where information in a task is updated over time; Ubiquitous predicates model the varying degrees to which items may suggest alignment; Structural evaluation of analogical inferences models aspects of plausibility judgments; Match filters enable large-scale task models to communicate constraints to SME to influence the mapping process. Any account of James’s ethics must be constructive and clarifying. As James scholars know, he only wrote (...) one essay focused exclusively on philosophical issues in ethics: “The Moral Philosopher and the Moral Life.” Nonetheless, James’s writings are rife with ethical themes presented in piecemeal fashion. Any interpreter of James’s ethics must fit these different pieces together and smooth out apparent inconsistencies.Lekan maintains that James’s writings on ethics take on two different perspectives. First, the social moral philosopher “seeks to create an inclusive moral order through expansion of sympathetic concern among those committed to different ideals” (2). Second, the existential moral philosopher “addresses the concerns of the moral agent seeking to abate existential doubts, particularly those that arise in the face of evil and suffering” (2). These two perspectives on ethical matters constrain one another, as I shall explain.On Lekan’s account, James’s moral philosophy begins like most pragmatist theories: with persons as we find them, in the thick of life, having diverse interests, and confronting genuine problems that call for a solution. Lekan writes, “James’s starting point is that of a complex self who has limited altruism rooted in sympathetic awareness of like-minded others. Moral philosophy’s fundamental problem is how to extend this limited sympathy to others who do not share one’s values” (4).At the heart of chapter 1 and the book as a whole is Lekan’s defense of the social-moral philosopher’s “Inclusivity Ideal” (15). The Inclusivity Ideal consists of two tenets: (1) “We are morally obligated to satisfy as many demands as possible,” and (2) “among the available ideals we might choose, we are morally obligated to adopt ideals whose realization does not undermine the ideals held by others” (15). Lekan regards the Inclusivity Ideal as a second-order regulative ideal. It is an ideal that “enjoins us to continuously strive for a social order that accommodates diverse ideals” (50). One will naturally wonder what argument supports adoption of the Inclusivity Ideal.Lekan’s argument is rooted in the Sentiogenic Thesis that “goods originate from the desires of sentient beings” (16, emphasis in original). It is because sentient beings have desires that any action can be good or bad at all. Lekan grounds this thesis in James’s Darwinian naturalism according to which “sentience is a function that evolves to fulfill the organism’s need to establish harmony with its environing circumstances” (18). Lekan’s account of what harmony consists in is not developed; he seems to hold that its contrary is frustration arising from when one’s “activities are blocked” (18). I should note that in other places, Lekan phrases the Sentiogenic Thesis as the thesis that “values originate from the feelings of sentient beings” (18). Lekan is not explicit about how desires and feelings are related and how this impacts what is good or has value.Taking the Sentiogenic Thesis in its first formulation as about desires, two additional theses come into play. The first is the Demand Obligation Thesis that “some sentient being S demanding F is necessary and sufficient to generate a prima facie obligation for satisfying S’s demand for F,” and the second is the Essence of Good Thesis that “the essence of the [End Page 671] good is demand satisfaction” (16). A meta-analytic review of studies that experimentally elicited awe and compared the emotion to other conditions (84; 487 effects; 17,801 participants) examined the degree to which experimentally elicited awe (1) affects outcomes relative to other positive emotions (2) affects experience, judgment, behaviour, and physiology, and (3) differs in its effects if the awe state was elicited through positive or threatening contexts. The efficacy of methods that have been used to experimentally elicit awe and the possibility of assessing changes in the (...) state of the self with experimental awe elicitations were also examined. Meta-analyses with robust variance estimation revealed that awe affected outcomes compared to other positive emotions and control conditions; affected experience, judgment, and behaviour; and had similar effects if elicited through positive or threatening contexts. The ability to compare awe to negative emotion states and its effects on physiology was limited by a small number of available effects. Images, videos, autobiographical recall, and naturalistic exposure were effective in eliciting awe. Exploratory analyses suggested that some processes involved in changes in the self can be related to experimental awe elicitations. These findings suggest awe is a discrete emotion and identifies areas for future investigation. (shrink)

OLWIG London: Routledge, 2019 REVIEWED BY TIMM SCHÖNFELDER Landscape is more than spatial scenery that meets the eye: it is an anthropogenic artefact, an intellectual construct, a mirror of culture; it even has its own language.1 This broadness is reflected in the compilation of nine authoritative essays by the geographer (...) and professor of landscape architecture Kenneth R. Olwig that were published during the past quarter of a century and are now molded into a more coherent whole. In this regard, the present volume can be considered the pinnacle of Olwig’s intellectual oeuvre. In a fervent foreword, the anthropologist Tim Ingold sets the tone when he urges the reader to shed the contemporary notion of what he terms “topophobia”—­ a lack of bond betweenpeopleandplaces—­andtoreinstatephilologyasacentralfield of interest after it was “relegated by techno-­ science to the margins of scholarship” (xv). To achieve this, the essays deal with an eclectic set of themes ranging from Ptolemy’s notion of “choros” as something similar to today’s understanding of landscape, to the humanistic geographer Yi-­Fu Tuan’s concept of “topophilia,” which is hailed as a guiding ideal for much of Olwig’s work. The articles are bound together by an introduction that quickly transcendsthegeometricallimitationsoflandscape,ontologicallyquestioning whether these can be representative of the world itself at all (3). The first chapter thus delves right into the etymologies of “landscape” and its historical implications in the Nordic countries and England with detours through Italy and the German lands. In a cursory, highly associative manner Olwig fathoms the respective cultural implications. Central is the idea that the concept of landscape is more than the mere scenicrepresentationofspaceitcametobeknownasinRenaissance art and culture.2 Rather, the Nordic variants of the word, like the Swedish landskap, are used to denote natural regions with their own polity that were then gradually subjected to a monarchic state, not least through the surveying and mapping of their territory (see also chapter two). ENVIRONMENT, SPACE, PLACE / VOLUME 13 / ISSUE 2 / 2021 138 At times, Olwig’s philological musings appear rather stretched, as when he associates the German word Grundgesetz (the “basic/­ fundamental law” of 1949, which until today serves as Germany’s constitution ) with a biopolitical dimension of “ground” as in “soil” (41).3 In cases like this, his use of literature is selective. This culminates in a problematic assessment of Nazi ideology as being motivated by a specific understanding of landscape. Statements like “there can be no doubt that the modern German conception of Landschaft was implicated in the promotion of blood-­ and-­ soil fascist ideology” (42) neglect important literature on the topic.4 Such generalizations are owed to the author’s sweeping tour de force approach. The reviewer would have preferred more guidance through the theoretical thickets by way of a clear, chronologically ordered argument. This is not helped by the occasional seeming inconsistency, as in the claim that the U.S. “inherited the British scenic idea of landscape” as a former colony while also being “very much the inheritor of German romantic ideas concerning the relation of culture to nature as expressed in the physical landscape” (45), which, in turn, showed parallels to “fascist landscapes” in the “attempt to cleanse geography of its environmentalist taint by making it a science of space” (42). This truly is a lot of ground to cover for one essay. The ensuing chapters, however, try to disentangle this inspired jumble. The second article, “Landscape, Place, and the State of Progress,” identifies a switch since the Renaissance from the idea of circuitous development to linear progress towards utopia. For Olwig, there is a “darker, Faustian side” to it that he identifies as the “dialectic of modernity,” which “opposes cosmic dreams of a utopian future to the topian exigencies of present and past”: to advance, the path had to be cleared of traditional elements (52). This materialized in courteous theatre as well as in Shakespeare’s popular plays, and in the new architecture of parks where landscape was symbolic for cultural and social progress (64). “Choros, place, and the spatialization of landscape” traces important theoretical threads within geography... This brief 1994 book review essay (5500 words) examines Telford Taylor's memoir, The Anatomy of the Nuremberg Trials (1992). The review is a personal one, set against two things - the author's work, while reading Taylor's memoir, in Iraq for Human Rights Watch leading a forensic team excavating Kurdish victims of the 1988 al-Anfal campaign, and the diplomatic discussions leading to the formation of the International Criminal Tribunal for Yugoslavia. The essay argues that the Nuremberg trials, according to Taylor, had (...) a certain deflationary emotional affect - deliberately ratcheting down the emotions of what had occurred to the limited world of the courtroom. It was able to do that because the WWII allies had been willing to pay the price of victory and had 'earned' the right to conduct a trial. The Yugoslavia tribunal, by contrast, and at that time, was premised on a claim to universal justice that did not depend upon the willingness of its sponsors to intervene in the slaughter in the former Yugoslavia. "Nuremberg was a lovely hood ornament," said one of the author's unnamed sources, a senior European military judge advocate, "on the ungainly vehicle that liberated Western Europe, but it was not a substitute for D-Day.". Toronto: University of Toronto Press, 1982. Pp. xi + 233. $28.50. Kenneth Dorter of the University of Guelph has given us a useful and unusual study of the Phaedo, which will attract the interest of a variety of Plato's readers. He provides the careful studies of (...) the dialogue's arguments for immortality to be expected in a sound commentary, paying close attention to the text as well as to recent scholarship, and displaying a good sense of argument. What gives the book additional interest, however, are its features as an interpretation of the Phaedo. Two stand out. First, Dorter wishes to give full weight not only to the logic of the arguments but also to the dramatic details of Plato's writing, believing these to be important in disclosing Plato's intentions. Secondly, he reads the Phaedo in light of a more general understanding of Plato's philosophy, especially the nature of the soul in its cosmic as well as individual aspects. Much of this is set out in a final speculative chapter, where Dorter seeks to make intelligible Plato's developing conception of soul by means of such notions as energy and poles of consciousness. Not every reader will be persuaded; but Dorter is to be commended for an attempt to move the discussion beyond the Phaedo and Plato's own vocabulary. The study gains its coherence from Dorter's belief that Plato's view of soul cannot support the ostensible aim of the dialogue, to provide reassurance of personal immortality. Although he has no doubt that for the Platonic Socrates there is "a meaningful sense in which we may be called immortal" (94, cf. 159), Dorter's analysis must be stretched to provide that sense. In part this is a result of his assessment of the arguments. The first, from reciprocity in nature, can at most show that, given the eternal nature of the world, soul and corporeality in general must continue to exist. The argument from recollection can point only to a non-empirical element in our knowledge ; that from the soul's kinship with the divine is best seen as an analogy developed to awaken within us a sense of eternity. The final argument, though containing fallacies (157), will support the conclusion that immortal soul is imperishable as long as soul is regarded as motive force in the universe, in the first argument's sense. In none of these discussions, then, can Plato's reasoning yield up personal survival. But there is another part to Dorter's case, underlying this conclusion. For Plato the individual human being is a composite of soul and body; so even if Plato were to prove the immortality of the soul he could never establish personal survival (63-64). It is not surprising then that Dorter is left with a doctrine of immortality either reduced to a "discovery of eternity within ourselves" (77), or else dissolved into a principle of enduring cosmic energy. So in neither case does it seem meaningful for Plato to say that we are immortal: the eternal which we sense is no more us than it is anything else. Although it is of course possible that Plato did not intend this consequence of his arguments, Dorter thinks otherwise. In support he invokes literary features of the dialogue to argue that Plato operates on one level for the less sophisticated (who wish to be persuaded of personal survival) and on another for the philosophically reflective reader. Dorter treats the textual evidence for this claim with an appropriate modesty, and tries to justify Plato's apparent duplicity as an attempt to convince the weak by a 'noble lie' (95-97). Nevertheless this leads Dorter to mix together too quickly for this reader popular religion, myth, and metaphor. To the fact that Plato does not espouse the language of popular religion literally, Dorter adds his own view of myth as an imaginative appeal to emotion that can be translated without loss into rational discourse (7, 165, a95). This paper aims to clarify certain features of the systematicity arguments by a review of some of the largely underexamined background in Chomsky’s and Fodor’s early work on transformational grammar.

In this paper, I propose two theses, and then examine what the consequences of those theses are for discussions of reduction and emergence. The first thesis is that what have traditionally been seen as robust, reductions of one theory or one branch of science by another more fundamental one are a largely a myth. Although there are such reductions in the physical sciences, they are quite rare, and depend on special requirements. In the biological sciences, these prima facie sweeping reductions (...) fade away, like the body of the famous Cheshire cat, leaving only a smile.... The second thesis is that the "smiles" are fragmentary patchy explanations, and though patchy and fragmentary, they are very important, potentially Nobel-prize winning advances. To get the best grasp of these "smiles," I want to argue that, we need to return to the roots of discussions and analyses of scientific explanation more generally, and not focus mainly on reduction models, though three conditions based on earlier reduction models are retained in the present analysis. I briefly review the scientific explanation literature as it relates to reduction, and then offer my account of explanation. The account of scientific explanation I present is one I have discussed before, but in this paper I try to simplify it, and characterize it as involving field elements and a preferred causal model system abbreviated as FE and PCMS. In an important sense, this FE and PCMS analysis locates an "explanation" in a typical scientific research article. This FE and PCMS account is illustrated using a recent set of neurogenetic papers on two kinds of worm foraging behaviors: solitary and social feeding. One of the preferred model systems from a 2002 Nature article in this set is used to exemplify the FE and PCMS analysis, which is shown to have both reductive and nonreductive aspects. The paper closes with a brief discussion of how this FE and PCMS approach differs from and is congruent with Bickle's "ruthless reductionism" and the recently revived mechanistic philosophy of science of Machamer, Darden, and Craver. Jeremy Waldron is well known for his disdain of U.S. jurisprudential doc- trine that allows courts to invalidate democratically enacted legislation on the ground it violates certain fundamental constitutional (and quasi-moral) rights. He believes that where disagreement on the relevant substantive is- sues is widespread among citizens and officials alike, it is illegitimate for judges to impose their views on the majority by invalidating a piece of enacted law. Even if we assume, plausibly enough, there are objective moral constraints on (...) what restrictions on behavior may be enacted into law, judges have no privileged access to the objective truth and must, like everyone else, rely on their own subjective intuitions and views. Given that judges are hence no more likely than citizens or legislators to reach the correct decision about what morality requires, these disagreements should be democratically resolved. As he puts it, if disagreement about rights is to be sorted out by counting heads, it should be the heads of citizens who have ultimate sovereignty in a democracy, rather than those of unelected judges, that ought to count.In this essay, I consider Wilfrid Waluchow’s response to Waldron’s argument in his outstanding new book, A Common Law Theory of Judicial Re- view, in which he attempts to provide the practice of judicial review with something akin to the foundation that justifies allowing judges authority over the development of the common law. Background: In the last two decades, nursing authors have published ethical analyses of palliative sedation—an end-of-life care practice that also receives significant attention in the broader medical and bioethics literature. This nursing literature is important, because it contributes to disciplinary understandings about nursing values and responsibilities in end-of-life care. Research aim: The purpose of this project is to review existing nursing ethics literature about palliative sedation, and to analyze how nurses’ moral identities are portrayed within this literature. Research design: We (...) reviewed discussion papers, written by nurses about the ethics of palliative sedation, which were cited in MEDLINE, CINAHL, Nursing and Allied Health, or Philosopher’s Index (search date March 2018). Twenty-one papers met selection criteria. We performed a comprehensive review and analysis (using the Qualitative Analysis Guide of Leuven), of the values, responsibilities, and relationships reflected in authors’ portrayal of the nursing role. Findings: Two different tones are apparent in the extant nursing ethics literature. One is educational, while the other is critically reflective. Irrespective of tone, all authors agree on the alleviation of suffering as a fundamental nursing responsibility. However, they differ in their analysis of this responsibility in relation to other values in end-of-life care, including those that depend on consciousness. Finally, authors emphasize the importance of subjective and experience-based understandings of palliative sedation, which they argue as depending on nurses’ proximity to patients and families in end-of-life care. Discussion and conclusion: Based on our findings, we develop three recommendations for future writing by nurses about palliative sedation. These relate to the responsibility of recognizing how consciousness might matter in (some) peoples’ moral experiences of death and dying, to the importance of moral reflectiveness in nursing practice, and to the value of a relational approach in conceptualizing the nursing ethics of palliative sedation. She did some public speaking during the ccny case in 1940, and in 1946 she organized a major meeting in Cambridge for the Save Europe Now organization. Later in the 1940s she began employment in town planning, and brief mentions of that topic show up in Authority and the Individualz (1949). The Bodleian Library, Oxford, has a box of her papers, placed, at her instructions, under a very lengthy embargo. Anne Conway’s Principles of the Most Ancient and Modern Philosophy, first published in 1690, is probably the most ambitious contribution to early modern metaphysics by a woman writing in the English language. This beautifully prepared edition makes Conway’s treatise available to twentieth-century readers in an accessible English translation of the 1690 Latin text—itself a translation of an original English manuscript that has long been lost.
